TERMS AND CONDITIONS OF BUYING AND SELLING
1. General provisions
1.1 These Terms and Conditions of Buying and Selling Goods (Terms and Conditions) is a Buying and Selling Contract, which is signed between the online store Aradia Silver (Seller) and You (Buyer).
1.2 This is a binding legal document, where the rights and obligations of the Seller and the Buyer, the conditions of purchasing goods and paying for them, the delivery and return policy, the responsibility of the parties and other provisions, related to buying and selling goods from the online store http://www.aradiasidabras.lt are defined. 1.3 All legal and natural persons that are adults and their proceedings are not restricted by court and minors aged between 14 to 18 years only having an agreement of parents or legal guardians, except the cases when they dispose their own income have the right to buy from the online store http://www.aradiasidabras.lt. 1.4 The Buyer, by accepting the Terms and Conditions, guarantees that, based on the point 1.3, has the right to buy goods from the online store http://www.aradiasidabras.lt.
1.5 The contract between the Buyer and the Seller is considered binding from the moment when the Buyer adds goods to the cart, enters a delivery address, selects a payment method, reads the rules, and presses the “Buy” button (see point 5 “Ordering goods, prices, payment methods, terms”)
2. Protection of personal data
2.1 By conducting e-commerce, the Seller complies with the provisions of the Law on the Protection of Personal Data of the Republic of Lithuania, the orders of the Director of Inspection and other legal acts.
2.3 Completing the registration form of the online store http://www.aradiasidabras.lt, the Buyer must provide correct personal data. The Buyer is responsible for submitting the correct data. 2.4 By accepting these Terms and Conditions the Buyer agrees that the personal data provided by the Buyer will be used for the sale of goods and services from the online store http://www.aradiasidabras.lt, analysis of the Seller’s activity and direct marketing purposes. The Buyer also agrees that the e-mail and telephone number given by the Buyer will be used to send informational messages, required for the fulfilment of this Contract. 2.5 By registering and ordering goods from the online store, the Buyer becomes responsible for the protection and non-disclosure of his login details to anyone.
3. Rights and obligations of the Buyer
3.1 The Buyer has the right to buy goods from the online store http://www.aradiasidabras.lt according to the procedure of these Terms and Conditions and other sources of information of this online store. 3.2 The Buyer has the right to withdraw from the Buying and Selling contract with the online store http://www.aradiasidabras.lt within 14 days from the delivery of goods by informing the Seller in written form, except the cases, when the withdrawal is not possible according to laws of the Republic of Lithuania (for example, the contract of selling precious metals and precious metals articles). 3.3 The Buyer commits to check the condition of the package and to accept the delivery.
3.4 If the data, provided in the registration form has been changed, the Buyer must immediately update it.
3.5 The Buyer commits not to disclose his login data to any third parties. If login data is lost, the Buyer must immediately inform the Seller.
3.6 By using the online store http://www.aradiasidabras.lt, the Buyer agrees with these Terms and Conditions and commits to comply with them and to not violate the laws of the Republic of Lithuania.
4. Rights and obligations of the Seller
4.1 The Seller commits to create all conditions for the Buyer to properly use the services provided of the online store http://www.aradiasidabras.lt
4.2 It is prohibited to use the Store in a way that may cause danger to a proper functioning of the Store, its safety, integrity or to restrict the ability of other persons to use the Store. If the Buyer tries to undermine the stability and safety of the online store, the Seller has the right to restrict, suspend or cancel the Buyer’s ability to use the online store http://www.aradiasidabras.lt immediately and without warning, stop the processing of his orders. 4.3 The Seller commits to respect the Buyer's right to privacy of personal data, provided in the registration form of the online store http://www.aradiasidabras.lt and not to disclose this data to any third parties, unless this data is necessary to process the Buyer’s order. 4.4 The Seller commits to deliver the Buyer’s ordered goods to the address indicated by the Buyer.
5. Ordering goods, prices, payment methods, terms
5.1 The Buyer may buy from the online store http://www.aradiasidabras.lt 7 days a week, 24 hours per day, unless there is an announcement about changes or vacations. 5.2.1 An item is sent to the Buyer within 1-4 working days after the payment is received.
5.3 The contract comes into force from that moment, when the Seller, after receiving the order, confirms it by sending the confirmation email to the email address provided by the Buyer.
5.5 The Buyer may pay for the goods:
5.5.1 pay online through the payment system chosen by the Buyer
5.6 The Buyer commits to pay for the goods within 48 hours from receiving the confirmation email. The package will be prepared, and the delivery time will be calculated only after payment for the goods is received.
5.7 If the Buyer does not pay within 48 hours, the order is cancelled.
6. Delivery
6.1 When placing an order, the Buyer commits to provide an exact address for the delivery, including a postal code and a correct phone number of the package recipient.
6.2 The Buyer commits to accept the goods himself/herself or the package can be accepted by the person that is at the place which address is provided in the order form. If the Buyer or other person at the address provided are not able to accept the goods which are delivered to the correct address, the Buyer does not have the right to make any claims regarding the failure to fulfil the delivery terms.
6.3 In Lithuania and abroad goods are delivered to the Buyer by AB Lietuvos pastas.
6.4 When goods are delivered, the Buyer or the person, indicated by the Buyer or the person that is at the address indicated in the order form, must check the condition of the package. If the Buyer, the person, indicated by the Buyer or a person that is at the address indicated in the order form that accepts the goods notices external damage of the package, he/she must mark this in the invoice and write a free form act of damaged package. An invoice, without any notes, signed by the Buyer, the person, indicated by the Buyer or the person that is at the address indicated in the order form, implies that the packaged was delivered undamaged.
6.5 The Buyer agrees, that when goods are delivered to the address indicated by the Buyer and when a person that accepts the package or the Buyer signs the goods acceptance document, it is considered that the goods were properly delivered to the Buyer and the Buyer does not have any claims.
6.6 If the Buyer refuses to accept the goods that were ordered or if the delivery of goods is not possible because the Buyer indicated the wrong delivery address when ordering goods, the Buyer must compensate the Seller any losses incurred because of this.
6.7 The Seller is not liable if the goods are not delivered to the Buyer or delivery is delayed due to the fault of third parties or circumstances which could not be controlled and foreseen at the moment of signing the buying and selling contract and the Seller was not able to prevent these circumstances or their consequences.
7. Return and exchange of goods
7.1 The return of goods is regulated by the Articles 6.366 and 6.367 of the Civil Code of the Republic of Lithuania.
7.2 The Seller guarantees the quality of the goods, so if a defective item was received, the Buyer must immediately and no later than within 14 days contact the Seller. If the item is defective, money will be reimbursed when the good is returned – when the return of the good is done using a parcel service at the Buyers cost.
7.3 The procedure of withdrawal from the contract, signed using means of communication: The Buyer has the right of withdrawal from a distance contract (right to return the product, that he/she bought online) within 14 days of the reception of the goods. In this case, the Buyer must inform the Seller about the withdrawal from the contract, providing the Seller a properly completed contract withdrawal form (it can be found here: https://www.e-tar.lt/portal/lt/legalAct/dad7f330d05511e3a8ded1a0f5aff0a9 ) or with a clear statement that in detail explains why he/she have decided to withdraw from the contract and immediately, no later than 14 days of submitting the application about withdrawal from the contract to the Seller send or return the good back to the Seller, unless the contract with the Buyer states that if the contract is withdrawn, the Seller has the responsibility to take back the goods. The Seller, no later than within 14 days of the reception of the Buyer’s contract withdrawal form and the reception of the returned goods, refunds the Buyer the full paid amount. However, the Buyer must cover the return costs of the refunded goods. 7.4 Good’s exchange-return procedure:
- Based on the laws of the Republic of Lithuania returns of jewellery are accepted only when the goods are defective.
- A written request is sent by email to info@aradiasilver.com stating the reason why the good is to be exchanged or returned.
- Complete the exchange-return form and send it by email.
- Pack the good and return it to the Seller 7.4.1 Used, modified or damaged goods are not returnable and not exchangeable. Goods must be returned in their original packaging with quality certificates/hallmark certificates and undamaged labels
7.4.2 For additional security do not mark the returned goods shipment as “jewellery” or use other words that may imply the content or the value of the shipped goods.
8. Intellectual property
8.1 All rights to the online store and goods found on it are reserved. Any content or information found on the online store cannot be copied, made publicly available or distributed without prior written agreement of the Seller.
8.2 All brands, that are presented on the online store is the property of the Seller or the Seller has the right to use them.
9. Laws
9.1 These Terms and Conditions are created based on the laws and regulations of the Republic of Lithuania. The Laws of the Republic of Lithuania apply to this Contract.
9.2 All disputes arising from the execution of these Terms and Conditions, are resolved by negotiation. Failing to reach an agreement, disputes will be resolved in accordance to the procedures established by the laws of the Republic of Lithuania.

11. Validity of the Terms and Conditions
These Terms and Conditions take effect as of June 1, 2018, and are valid indefinitely.
